Terms and Conditions

These Terms and Conditions govern all legal relationships between GerryProfitCapital Management FZCO and the users of the CryptoFundX99 platform. They apply to all functions, services, content, trading services, wallet functions, referral systems, bonus programs, websites, mobile applications, community areas and any future extensions of the platform. By registering, using the platform or making a deposit, the user expressly confirms that they have read, understood and accepted these Terms and Conditions. Users who do not agree with any provision of these Terms and Conditions are not permitted to use the platform. CryptoFundX99 does not provide financial, investment, asset-management, tax or legal advice. All decisions concerning deposits, trading activation and withdrawals are made independently and at the sole responsibility of the user.

Registration is required to use the platform. The user agrees to: • provide only complete and accurate information • keep their personal information up to date • keep their login credentials confidential • not transfer or provide access to their account to any third party Each user is generally permitted to hold only one user account. Multiple accounts, also referred to as multi-accounting, are prohibited without prior written approval from the Operator. The Operator is entitled to: • reject registrations • merge accounts • suspend duplicate accounts • permanently exclude users from the platform Unless proven otherwise, all activities carried out through a user account shall be deemed to have been performed or authorised by the respective account holder.

All deposits are made voluntarily. Once a deposit has been successfully credited, it will be displayed in the user’s personal wallet. The wallet is used exclusively for managing funds within the platform. Important: • A deposit does not automatically mean that the funds participate in trading. • The funds initially remain fully available in the user’s wallet. • As long as the funds have not been activated through the “Invest Now” function, they generally remain available for withdrawal in accordance with the applicable platform rules. The Operator accepts no liability for deposits sent to an incorrect wallet address, through an unsupported network or using an incorrect cryptocurrency or token.

Participation in trading takes place exclusively through the user’s express activation of funds using the “Invest Now” function. Only after this activation are the funds allocated to trading capital. By activating the funds, the user expressly agrees to the applicable trading rules. From the time of activation, the following conditions apply in particular: • the activated capital participates in trading • the capital remains committed to trading • repayment or release of the invested capital will only take place after the applicable release requirements have been fulfilled • profits and losses are allocated in accordance with the applicable platform rules

The so-called 150% rule applies to every activated investment. The originally activated investment remains committed to trading until trading profits equal to 150% of the original investment amount have been generated. Only after this requirement has been fulfilled will the investment be released for withdrawal in accordance with the platform rules applicable at that time. This rule applies exclusively to activated trading capital. Wallet funds that have not been activated are not affected by this rule.

Trading results are displayed regularly in the user dashboard. The information is provided to the best of the Operator’s knowledge. However, no guarantee is given regarding permanent availability, completeness or freedom from errors. CryptoFundX99 does not guarantee: • profits • returns • a particular number or frequency of trades • achievement of profits within a specific period All displayed trading results, statistics and performance figures are based solely on historical data and do not guarantee future results.

The current minimum investment required to participate in trading is 250 USDT. Deposits below this amount: • remain in the user’s wallet • do not participate in trading • may be withdrawn in accordance with the applicable platform rules Referral commissions may still be calculated in accordance with the current compensation plan. The Operator reserves the right to adjust the minimum investment amount at any time.

CryptoFundX99 provides a voluntary referral program. Users may invite other individuals through their personal referral link. Commissions are calculated automatically and initially displayed in the user’s dashboard. The display of a commission does not automatically create a right to payment. A commission becomes payable only after it has been approved manually or automatically by the Operator. The Operator reserves the right to withhold, cancel, adjust or reclaim commissions where necessary, including but not limited to cases involving: • fraud • abuse of the referral system • multi-accounting • manipulation • false or misleading information • technical errors • violations of these Terms and Conditions • compliance or legal requirements Users have no guaranteed or vested right to future referral commissions.

Withdrawals must be actively requested by the user through the platform. Before processing a withdrawal, the Operator may conduct: • identity verification (KYC) • security checks • compliance reviews • Anti-Money Laundering (AML) checks • additional verification procedures where required Withdrawals may be delayed, suspended or rejected where: • required by applicable laws or regulations • security concerns exist • suspicious or irregular activity has been detected • a violation of these Terms and Conditions is suspected • additional verification is required Blockchain network fees, transaction fees and other applicable processing fees may be deducted from the withdrawal amount. The Operator reserves the right to introduce fully or partially automated withdrawal processing in the future.

Trading cryptocurrencies and digital assets involves significant financial risk. The user acknowledges and understands that: • profits are never guaranteed • losses may occur at any time • part or all of the invested capital may be lost Past trading performance does not guarantee future results. Each user participates entirely at their own risk and accepts full responsibility for their trading decisions.

To the maximum extent permitted by applicable law, CryptoFundX99 and GerryProfitCapital Management FZCO shall not be liable for any losses, damages or expenses resulting from, including but not limited to: • trading losses • market price fluctuations • technical failures • server downtime • scheduled maintenance • blockchain-related issues • network interruptions • cyberattacks or hacking incidents • force majeure events • failures or errors of third-party exchanges • delays in blockchain confirmations • delays caused by payment providers or third parties • internet outages or connectivity issues CryptoFundX99 makes no warranty or guarantee regarding: • profits • investment returns • uninterrupted platform availability • continuous trading opportunities The platform is provided on an “as is” and “as available” basis. Use of the platform is entirely at the user’s own risk.

CryptoFundX99 is a project operated by GerryProfitCapital Management FZCO. The name CryptoFundX99, all logos, graphics, images, videos, texts, documents, presentations, designs, software components and all other content published on the platform are intended exclusively for use within CryptoFundX99. By registering, the user acknowledges that all platform content is provided solely for use within the CryptoFundX99 ecosystem. Without the prior written permission of GerryProfitCapital Management FZCO, it is strictly prohibited to: • use the name CryptoFundX99 or any confusingly similar name for personal or commercial projects • copy, reproduce, distribute, modify or reuse the platform’s logos, images, texts, videos or any other content in whole or in part • operate websites, landing pages or internet domains using the CryptoFundX99 name, logo or visual identity • create or operate Telegram groups, WhatsApp groups, Discord servers, Facebook groups, Instagram pages, YouTube channels, X (Twitter) accounts or any other social media channels using the CryptoFundX99 name, logo or branding • present yourself as an official representative, partner or affiliate of CryptoFundX99 without prior written authorization from GerryProfitCapital Management FZCO • promote, advertise or recommend any third-party company, investment opportunity, cryptocurrency project, service or product while using the CryptoFundX99 name, logo, branding or platform content • use any platform content for misleading, fraudulent, illegal or deceptive purposes These restrictions apply regardless of whether the CryptoFundX99 name, logo or other content is protected by trademark, copyright or any other intellectual property laws.

Each user agrees to: • use the platform only for lawful purposes • comply with all applicable laws and regulations • refrain from bypassing or attempting to bypass any security measures implemented by the platform • refrain from manipulating or interfering with the operation of the platform • provide accurate and truthful information at all times • not deceive, mislead or harm other users • not engage in spam, fraud, phishing or similar activities through the platform or while using the CryptoFundX99 name or branding • refrain from intentionally damaging the reputation of CryptoFundX99 through misuse of its name, content or services

Any violation of these Terms and Conditions constitutes a material breach of the agreement between the user and the Operator. In such cases, GerryProfitCapital Management FZCO reserves the right, at its sole discretion, to: • temporarily or permanently suspend a user account • immediately terminate access to the platform • permanently exclude the user from CryptoFundX99 • permanently remove the user from the Referral Program, Bonus Program or any future incentive program • cancel any unpaid commissions, bonuses or other rewards • temporarily suspend withdrawals while an investigation is being conducted, where legally permitted • recover commissions, bonuses or other payments that were obtained through fraud, abuse or violation of these Terms and Conditions, to the extent permitted by law • pursue any additional contractual or legal remedies available Users acknowledge that participation in CryptoFundX99 and its Referral Program is a privilege and not a guaranteed contractual right.

Personal data is processed only to the extent necessary for the operation of the platform and in accordance with applicable data protection laws. Further information regarding the collection, processing and storage of personal data can be found in the separate Privacy Policy. By using the platform, the user agrees to the processing of personal data as described in the Privacy Policy.

GerryProfitCapital Management FZCO reserves the right to modify, update or discontinue, at any time and with future effect: • platform features • trading rules • compensation models • referral rules • bonus programs • technical processes • fees • security measures • and these Terms and Conditions Users will be informed of significant changes through appropriate communication channels. Continued use of the platform after such changes become effective constitutes acceptance of the revised Terms and Conditions, unless mandatory law provides otherwise.

These Terms and Conditions shall be governed exclusively by the laws of the United Arab Emirates (UAE). To the extent permitted by applicable law, the courts of Dubai, United Arab Emirates, shall have exclusive jurisdiction over any dispute arising out of or relating to the use of the CryptoFundX99 platform.

If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect. Any invalid or unenforceable provision shall be replaced by a legally permissible provision that most closely reflects the economic purpose of the original provision. The Operator’s failure to enforce any right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision in the future. The English version of these Terms and Conditions is provided for convenience. In the event of any inconsistency or discrepancy between language versions, the German version shall prevail, unless otherwise required by applicable law.

CryptoFundX99 is a digital cryptocurrency project operated by GerryProfitCapital Management FZCO. Trading cryptocurrencies and digital assets involves substantial financial risk and may result in the partial or complete loss of invested capital. Past trading performance, displayed returns or historical results do not guarantee future performance. Every user acts entirely at their own risk and should invest only funds whose complete loss they are financially able to bear. By registering, using the platform or making a deposit, the user expressly confirms that they have: • read and understood these Terms and Conditions • understood the risks associated with cryptocurrency trading • accepted these Terms and Conditions in their entirety
